LA1.3 Housing Allocations - Site Omission
If you have selected a ‘Site omission’ please enter the site reference or location and relevant policy below
RN187
1.1 Do you consider that the South Lakeland District Council Land Allocations DPD is legally compliant?
No
1.2 If NO please identify which test of legal compliance your representation relates to by selecting the relevant option(s) below and completing section 1.3.
The DPD has not been prepared in accordance with the Town & County Planning Regulations 2004 (as amended)
The DPD has not had regard to national policy and does not conform generally with the adopted Core Strategy and (until it is abolished) the Regional Spatial Strategy
2.1 Do you consider that the South Lakeland District Council Land Allocations DPD is sound?
No
2.2 If NO please identify which test of soundness your representation relates to by selecting the relevant option(s) below and completing section 2.3.
The DPD is not justified in that it is not founded on a robust and credible evidence base and/or is not considered the most appropriate strategy when considered against the reasonable alternatives.
The DPD is not effective in that the document is not deliverable, flexible or capable of being monitored.
The DPD is not consistent with national policy.
2.3 Please give details of the change(s) you consider necessary to make the South Lakeland District Council Land Allocations DPD sound, having regard to the test you have identified at question 2.2 above.
It would be helpful if you could state your proposed change to the DPD and the reasons why you think it is necessary.
RN187 - this brownfield site has not been designated for development. Beetham PC consider it suitable for (preferably) affordable residential housing and it could be extended by including the small adjacent (unreferenced) site along the B5282 to the immediate north (presently occupied by crago). Access problems to this and site EN40 could be resolved by the construction of a short link road between the B5282 and Quarry Lane, across site RN187.
Brownfield site RN187 is capable of development and omission from the list of designated sites is not justified.
2. Adverse consequences for Beetham West Ward.
Two adjacent brownfield sites in Sandside have not been designated
for development in the SLDC plan possibly because, individually,
their size fails to meet the overstrict site-size criteria (even though,
if combined, the criteria may be met). These sites, currently occupied
respectively by Travis Perkins and Cragco car body repairers, lie
along the B5282, north of the Ship Inn, bounded on one side by the
B5282 and on the other by Quarry Lane. Beetham Parish Council
believes that this combined site justifies serious consideration as
suitable for (preferably residential) development and should now
be included in the SLDC plan as a designated site.
Beetham Parish Council suggest that any problems ofaccess to these
sites, and the already designated area to the immediate east, could be
resolved by the construction of a short link road between the B5282
and Quarry Lane, across what is now the Travis Perkins site.
Beetham Parish Council believes that SLDC's present proposals are unsound and it should now produce a comprehensive and
cohesive development plan for Sandside, taking into account all the above considerations.

The DPD has not been prepared in accordance with the Town & County Planning Regulations 2004 (as amended)

1.3 Please give details of the change(s) you consider necessary to make the South Lakeland District Council Land Allocations DPD legally compliant, having regard to the test you have identified at question 1.2 above.
It would be helpful if you could state your proposed change to the DPD and the reasons why you think it is necessary.
The DPD does not uphold the "highest level of protection" to which an AONB is legally entitled (NPPF para 115)

As it stands the DPD will not deliver affordable housing to meet long term needs and is not coherent with neighbours (local AONB policy)
The DPd conflicts with national policy in that it does not provide the "highest level of protection" as specified for an AONB
1. SLDC's proposals are unsound and fail to follow due process:
a. land designated for residential development in Beetham's .
West Ward (Storth/Sandside) is very limited and fails to
address how identified local affordable housing needs
could be met in the plan's longer term (to 2025).
b. their space requirement criteria of a rigid, commercially
dnven (assumed 35%/65%) rat1o of affordable to total
housing numbers fail to take into account the more
sensitive and flexible approach required within an AONB,
as an area enjoying the highest level of protection.
c. these same criteria result in a minimum development site-size
requirement which is unnecessarily large, with more land
occupied and a greater total number of homes created
than actually needed.
d. this artificial minimum site-size requirement means that sites
are eliminated which are otherwise suitable for development,
including brownfield sites in need of regeneration.
e. the proposals have failed to win the full support of local
AONB management.
