1.1 Do you consider that the South Lakeland District Council Land Allocations DPD is legally compliant?

The DPD is not justified in that it is not founded on a robust and credible evidence base and/or is not considered the most appropriate strategy when considered against the reasonable alternatives.
2.3 Please give details of the change(s) you consider necessary to make the South Lakeland District Council Land Allocations DPD sound, having regard to the test you have identified at question 2.2 above.

Oxenholme is recognised as a Local Service Centre and in the description of it in paragraph 3.143 it is said that it contains Kendal's mainline railway station and that it has facilities including a local shop/Post Office, a petrol station and a pub. That description excludes the bakery which is in buildings at the station and a food distribution business that is also in the station. The development boundary has been drawn very tightly around existing development, together with the two allocated sites at the Southern end of the village, and a reasonable examination of that boundary shows no opportunities for infilling and rounding off, which is said in the text supporting policy LA1.1 to have been part of the review of development boundaries. The station, which is recognised as one of the main facilities, is not within the development boundary nor is the public house. At that end of the village there is an area of housing development along the road leading to Old Hutton where there are opportunities for infilling and rounding off and it would seem logical to amend the boundary of Oxenholme to include the station and the public house and those areas
fronting the road referred to above in order that the boundary should be seen as more logical, and that it should also offer some opportunity for development other than the two larger allocated sites referred to earlier. Attached is a plan showing the amended boundary to include the existing station facilities, the public house and the land suitable for infilling and rounding off, which already contains many houses which regard themselves as part of Oxenholme as a village.
