1.1 Do you consider that the South Lakeland District Council Land Allocations DPD is legally compliant?
No
1.2 If NO please identify which test of legal compliance your representation relates to by selecting the relevant option(s) below and completing section 1.3.
The DPD has not had regard to national policy and does not conform generally with the adopted Core Strategy and (until it is abolished) the Regional Spatial Strategy
The DPD has not had regard to the Sustainable Community Strategy
1.3 Please give details of the change(s) you consider necessary to make the South Lakeland District Council Land Allocations DPD legally compliant, having regard to the test you have identified at question 1.2 above. It would be helpful if you could state your proposed change to the DPD and the reasons why you think it is necessary.
There is clear guidance with regard to the special treatment of AONB geographies. I challenge that this has been complied with during the process of the journey of the Land Allocation DPD. On the Cumbria side of the Arnside & Silverdale AONB there are significant populations in Arnside, Storth / Sandside, ad Beetham / Slackhead. The distribution of sites allocated ignores the needs for growth in both Storth / Sandside and Beetham / Slackhead. The school populations in both Storth and Beetham, where I am a governor of both schools, need the potential of increased pupil numbers from population growth.

The test of deliverability which is seen as a prime driver in the site allocation process is flawed in that it is only a 'snapshot in time', with sites which may be offered towards the end of the timeframe potentially being different from those on offer in 2011. My studies on the growth of Arnside (Centre for North West Regional Studies, University of Lancaster) included investigation of the land holdings in the village, and the clear conclusion that the fragmented nature of these holdings resulted in the shape and tone of the village which is of special nature. The application of site size criteria is contrary to the organic growth of the village.

The identified need within Arnside is for a specific number of 'affordable housing'. The use of a multiplier to result in that identified need of itself produces a non-identified need of 'market value' properties. This is contrary to the spirit of the regulations.

The only site allocated within Storth / Sandside has significant constraints due to access, and yet a nearby brown field site has never been included in any consultation.
