The
Open Spaces Society (formally the Commons, Open Spaces and Footpaths
Preservation Society) was founded in 1865 and is Britain's oldest national
conservation body. It campaigns to protect common land, village greens,
open spaces and public paths, and people's right to enjoy them.
We strongly object to the inclusion of land at Bardsea being
included for consideration for development. On Map 43 the land is
referenced RN102. This land is registered as common land as CL112 and is
also access land under the Countryside and Rights of Way Act
2000.
The
land is protected under the Commons Act 2006 (previously the Commons
Registration Act 1965) and no building or works can be carried out without
consent from the Secretary of State under Section 38 of the Commons Act
2006.
In
addition the public have the right of access on foot over the whole of the
land.
Any
proposed development would be completely contrary to the above designations and
we would ask that this area be withdrawn from the proposals.
